Terms of Use
These terms govern your use of HITHER. By downloading or using the app, you agree to them and to Apple’s applicable App Store terms.
The service
HITHER helps you capture and return to personal moments using text, photos, audio, time, location, and contextual reminders. Features may vary by device, operating system, region, permission settings, and service availability.
Your content
You retain ownership of content you create in HITHER. You are responsible for having the right to record, store, or share it and for complying with laws that apply to audio, images, locations, and other personal information.
Important reminders and location limits
HITHER is a memory aid, not an emergency, safety, medical, legal, or mission-critical alert service. Notification, location, background processing, Watch transfer, transcription, and synchronization can be delayed or unavailable. Do not rely on HITHER for time-critical actions or personal safety.
Acceptable use
You may not misuse HITHER, interfere with its operation, attempt unauthorized access, reverse engineer it except where law expressly permits, or use it to violate another person’s rights or applicable law.
Purchases and subscriptions
Purchases are billed and managed through your Apple Account. Any subscription renews according to the terms displayed by Apple unless canceled through your Apple Account settings. Refunds are handled under Apple’s policies. Available plans, pricing, and features may change, subject to applicable law.
Apple services
Some features rely on Apple services including iCloud, CloudKit, location services, notifications, speech recognition, WatchConnectivity, and StoreKit. Their availability and operation are governed by Apple’s terms and are outside HITHER’s direct control.
Availability and changes
HITHER may be updated, changed, suspended, or discontinued. Reasonable care is taken in building the app, but uninterrupted or error-free operation is not guaranteed. Back up or export important content when appropriate.
Disclaimer and limitation
To the extent permitted by law, HITHER is provided “as is” and “as available,” without warranties not expressly required by law. The developer is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the app. Nothing in these terms excludes consumer rights or liability that cannot legally be excluded.
Termination
You may stop using HITHER at any time. Access may be limited if these terms are materially breached, subject to applicable law. Provisions that by their nature should survive termination will continue to apply.
Changes to these terms
These terms may be updated as HITHER evolves. Material changes will be reflected here with a new effective date. Continued use after an update means you accept the revised terms where permitted by law.
